The Bourbon County Commission met in open session with Harold, Barbara and the County Clerk was also present.

Loretta George with the Fort Scott Tribune was also present.

Bobby Guilfoyle with Craw-Kan Telephone met with the Commissioners. Craw-Kan needs to install a service line for a new residence at 313 and 50th. Barbara made a motion to waive the fees for the permits for 313 and 50th for Craw-Kan, Harold seconded.

Jim Harris recommended (to Barbara) considering waiving the fees and Barbara made the motion to waive the fees for the permit and a culvert at Paws and Claws (a non-profit organization) who wants to add a new driveway, Harold seconded.

William Wallis the Emergency Preparedness coordinator, met with the Commissioners. He said they will be doing Code Red training for approximately 10-12 people. Code Red is a mass notification system that sends notice of any emergencies that may occur in the County by text form.

William Wallis said they will be having fire chief meetings on a regular basis to help bring a closer connection between his department and all rural fire departments. He talked about a pasture fire that had been set which got out of hand and caught an oil field on fire; he talked about the volunteer fire departments that had assisted (and the way they worked together) in that call. He talked about training he had gone to regarding hazardous chemicals.

William also said they will be looking for a different mobile EOC vehicle. He said the current vehicle is operable but not large enough. He said they want to trade up, and in order to do this they will look for available grant money and will look at the excess equipment that the State or Federal government may have.

William talked about a required (he said this is required to receive other grant money for projects) Emergency Operation Plan (EOP). He said they had received a grant for $6,400 to help hire a contractor to write and prepare the EOP for Bourbon County.

Dennis Krom a resident in the Drywood area, talked to the Commissioners regarding the Garland Fire Department. He said when the Garland Fire Department held their budget hearing meeting there were residents that attending the meeting and voiced their opinion regarding a tax increase; however the Fire Department board did not listen to the concerns of the citizens. He said the fire department increased their budget over $9,000 more than 2014. He said Connie May said this was due to increased utility expenses and truck repairs. He was told that the fire department has $100,000 in a reserve account and he questioned the increased budget when there is a reserve. Mr. Krom said he is going to request written spending records of the fire department; he said he feels this is a legal and reasonable request. He questioned the fire department selling an air compressor on Purple Wave (instead of taking bids from local people that may have wanted to bid on it) that was listed on Purple Wave in working order; but said he was told that the fire department sold the air compressor because it was worn out. He said he would like to see transparency in the fire departments records.

Barbara said the Commissioners will be speaking at Kiwanis on September 16th at FSCC at noon.

David Wade a resident on Yale road near Mapleton, told the Commissioners about brush that needs to be cleared in this area as well as some road work that needs done in the area.

The Bourbon County Commission met in open session with all three Commissioners and the County Clerk present.

Tammy Helm with the Fort Scott Tribune was also present.

Allen moved to approve allowing the US Geological Survey to place a stream gage on the Marmaton River at the 235th street bridge, Harold seconded and all approved.

Allen made a motion to approve purchasing a 2006 Genie Industries S-40 Boom Lift with 1920 hours from Foley Tractor for $29,400 (to be paid for out of the Special Machinery Fund), pending inspection, Harold seconded and all approved.

Jim reported that the County is making and hauling asphalt to assist the City of Fort Scott on a project near the High School. He said this week they are working on removing a culvert and building the road up on 225th between Tomahawk and Unique road. He said they will be working on the bridge on 95th and Unity as well as ditching around the County.

Harold asked Jim to look at a wooden culvert needing repairs on an entrance field off of 135th and Xavier road.

Jim reported that he had looked at a wash out area on 190th and Hackberry road.

Terry Sercer presented a revised 2015 budget, after more adjustments are made, Harold made a motion to publish the 2015 budget hearing, Allen seconded and all approved. The budget hearing will be September 8th at 10:00 am. Terri Johnson suggested that each department receive and sign for a copy of the approved budget for their department.

Valorie Leblanc and Terri Johnson met with the Commissioners; Terri announced that Valorie received the Magistrates job in District Court. Terri said she needed to advertise to fill Valorie’s position, she said there may be an overlap between when the new employee starts and when Valorie takes the Magistrates job.

Rhonda Dunn told the Commissioners she wanted to check with a company called Kelly and Associates regarding tax auctions. She said they charge $200 a property.

Robert Jones with ECVIS called and talked to the Commissioners about ECVIS. ECVIS is a company that provides the software (estimated cost of $3,000-$5,000 annually to Bourbon County) for the County to look up grants that are available. Mr. Jones said typically people that use their company receive a good return on their investment (by finding grants available). The Commissioners said they would like to see what grants are available for equipment for security, drug prevention and grants that may be available to do work to the buildings at Elm Creek Lake. Mr. Jones sad he would email different grants that may be available. He will visit with the Commissioners again later on.

Allen made a motion to go into a 5 minute executive session for attorney client privilege regarding litigation, Barbara seconded (the session included the three Commissioners and Terri Johnson). No action was taken.

Barbara and Harold discussed the possibility of opening a quarry in the Southern part of the County.

Terry Sercer presented a revised 2015 budget. He reported that with the revised 2015 budget there would not be a mill levy increase (2015 mill levy same as 2014). Terry suggested that the Commissioners review the revised budget over the weekend and then publish it on August 28th.

Allen made a motion to go into a 30 minute executive session for attorney client privilege with possible litigation, Barbara seconded (the session included the Commissioners and Terri Johnson). No action was taken.

Timothy Kelly inquired about zoning requirements, (he said he wanted to do consignments South of Fort Scott) per the Commissioners, there is no zoning in Bourbon County (other than septic tank regulations).

Darrell Howard questioned if the taxpayers had purchased a mower with a big boom on it, the Commissioners reported that it was needed to do side trimming. Mr. Howard reported that on 200th from Eagle to Fern road needs mowed.

Rhonda Dunn gave the Commissioners a report on idle funds. She said there is $5.6 million in the banks. Rhonda also reported that the sewer district payment is approximately $30,000 (which when made will reduce the balance in that account).

Allen reported that he was disappointed that the Fort Scott Tribune would not print in 6 point font. There was discussion over how much less the delinquent tax listing would have cost had it been printed in 6 point font.

Dennis Meech met with the Commissioners regarding the condition of Soldier road.

David Neville reported that the fire alarm for the Courthouse had quit working. He said he had someone coming to repair it. Barbara suggested talking to Paul Ballou about hiring someone to do a walk through until the alarms are fixed.

The Bourbon County Commission met in open session for a 2015 budget work session. Present for the meeting were all three Commissioners, Terri Johnson, Terry Sercer and Rhonda Dunn.

Lora Holdridge questioned the Commissioners about what the Fort Scott Tribune had printed. The Tribune indicated that the Clerk’s office was getting a full time employee, but failed to print that the Register of Deeds office was also getting another full time employee.

The meeting was suspended at 11:50 am.

The meeting resumed again at 3:00 pm.

The Commissioners felt that the 2015 budget was almost ready for publication.

There was discussion over hiring a chief financial officer, but it is not budgeted for in 2015.

Jim Harris reported that KDOT has extended the chip and seal time frame to September; he advised that it takes 30 days for chip and seal to dry, he said crews would be able to continue working on projects longer due to the extension. They are planning to chip and seal in Redfield, Bronson and Mapleton.

Joe Dawson reported that 190th and Hackberry needs some attention.

There was discussion over opening a quarry in the southern part of Bourbon County in 2015. This should present a savings in fuel, time spent and wear and tear on vehicles. It is estimated that it would cost approximately $50,000 (which would add approximately ½ a mill to the 2015 levy). No decision was made regarding opening a new quarry.

Terri Johnson helped work on the Road and Bridge 2015 budget.

The Commissioners will have another 2015 budget work session on August 19, 2014 @ 1:00 pm.

The Bourbon County Commission met in open session with all three Commissioners and the County Clerk present.

Wally Maples the Elm Creek Caretaker, Bill Martin the Sheriff and Bill Cooper the District 3 Representative with ABATE of Kansas met with the Commissioners. ABATE is a non-profit organization promoting motorcycle awareness. Wally Maples said he felt the 2013 event went well and suggested allowing ABATE to have an event in 2014 (he felt the event may bring money to Bourbon County). He said they cleaned up after themselves when the 2013 event was over. Bill Cooper said there were 6 patrol cars and caution tape around the 2013 event at Elm Creek; he thought that may have detoured some people from attending. Bill Martin said he couldn’t make the decision as to whether they should allow the event, but that it was his job to have law enforcement present when there is any large gathering in Bourbon County (if he knows of the gathering). Barbara suggested that Wally be in contact with Bill Martin when there is a large gathering at the Lake. Allen said that Bill Martin is in charge of security and Wally Maples is responsible for Elm Creek Lake. Allen asked that they all work together to make this a successful and safe event. The Event will be held at Elm Creek Lake on October 3, 4 & 5th.

All three of the Commissioners will be attending the SEK Semi-Annual District Meeting on October 16th in Coffey County.

The Commissioners, Terry Sercer and Valorie Leblanc continued to work on the 2015 budget. There was discussion over more details needed from some of the department’s budgets. Terry Sercer suggested that departments do a budget in June in order for the Commissioners to start having budget sessions earlier in 2015. Terry Sercer said as of right now there is approximately around a mill increase from 2014-2015. The Commissioners will continue to work on the 2015 budget.

Terry Sercer talked with the Commissioners regarding the Sewer District #1; Terry said that when the County signed the contract in 2009 the County agreed to assess dollar amounts to cover operating costs, debt service and a reserve amount. The City has been collecting these fees and sending payments to the County. Terry said the County is responsible for reporting to the USDA; however this hasn’t been done because the City has the numbers needed to report. Terry said he will talk to the USDA to see what needs done.

Patricia Daniels met with the Commissioners and picked up a road closing petition for a portion of Eagle Road.

David Neville met with the Commissioners regarding the 2015 budget for the General fund. He suggested budgeting to start replacing air conditioners and boilers. There was discussion over budgeting for increased utility bills.

Barbara, Harold and Rhonda Dunn did the tie-breakers for the write in races from the 2014 Primary. The Commissioners then signed off on the official election results from the 2014 Primary.

The Commissioners, Terri Johnson, Rhonda Dunn and Terry Sercer continued to work on the 2015 budget.

The Bourbon County Commissioners met in open session with all three Commissioners and the County Clerk present.

Jim Harris talked to the Commissioners regarding placing stop signs around the County. Jim said he talked to the Engineer and the engineer said if the County feels a need to place a stop sign in a location there is no need to do a study.

Jim said there is another truck down in the Road & Bridge department. He said it needs approximately $5,000 in repairs (with high mileage). Jim said they are now two trucks short. Jim recommended selling the two trucks on Purple Wave. Jim estimated it would cost 25,000-30,000 for snow plows and salt spreader boxes for the trucks. Barbara recommended that Jim get some quotes to replace the two trucks.

Jim said they should be done on Yale Road on Tuesday. Jim said they are mowing around the County.

Jim said they are out of chips; he said there is a problem with the tracks on the crusher and Foley will be there to work on it. He said they should have chips by the end of the week. Allen said they will be chip and sealing in Redfield, Bronson and Mapleton.

Harold told Jim that 255th going north needs rock. Barbara asked Jim to look at the ditches at 825 going north.

Allen chose to not participate in the board of canvassers. Barbara moved that Rhonda Dunn serve on the board of canvassers for August 11, 2014 (in place of Allen) Harold seconded and all approved.

The Commissioners, Terri Johnson, Lynne Oharah, Katy Oharah, Kendell and Maggie Wolf were present for the canvass for the Primary 2014.

The meeting adjourned at 12:11 for lunch.

At 1:30 the Commissioners met again for a 2015 budget work session.

The Commissioners will meet again at 9:00 am on Tuesday August 12th, to have a special meeting for the purpose of determining any tie breakers from the 2014 Primary Election, that meeting will adjourn at approximately 9:15 am and then the Commissioners will have a 2015 budget work session.

The work session adjourned at 4:15 pm.

Bill Cooper the district 3 representative for the ABATE organization met with the Commissioners. He said they want to host an ABATE meeting again this year at Elm Creek Lake on October 3rd & 4th, 2014. He said they have applied for a permit to the State to have this event. He said they want to have this as an annual event at the Elm Creek Lake. He said this would be a family event, a donation only event, with two bands, fishing derby, horseshoes and gunny sack races. He said their organization does many things for communities as well as teach motorcycle safety. Allen told Mr. Cooper to turn the application for the use of Elm Creek into the Caretaker there, (as well as talk to the Sheriff) and then the Commissioners will meet with the caretaker and the Sheriff to get the details worked out.

Michelle Parker asked about the status of the paving of Stringtown Road (she said it is a heavily traveled road); she said this has been on the list of projects to be completed for several years and is still not done. She said there are roads in the County that are in worse condition than Jayhawk Road, (which was recently completed). Mrs. Parker said that when the County mowed there they left piles of brush everywhere. Allen told her that the road projects are taking longer than planned and they are running behind. He said he was unsure if this road would be completed in the fall.

Jeannie & Darrel Parker met with the Commissioners regarding Stringtown Road.   They asked how they can be on the list first two years in a row. They questioned why the County didn’t do Stringtown Road when they had the equipment already in the area before moving it across the County. They questioned how long it would have taken to finish while they were already in the area. Allen said they had left a project on Yale Road two years ago and they went back to finish it. Mrs. Parker said it is frustrating that the road hasn’t been done; she said she doesn’t understand not following through on the list of projects. Mr. Parker asked where the asphalt is made; Allen said it’s made at the Blake Quarry. The Parker’s talked about being taxpayers and said they would check back in 30 days regarding this road.

Robert Query talked to the Commissioners. He told Allen he was sorry he got beat. Mr. Query talked about the roads getting narrower in the County due to the way they are being maintained.

Harold made a motion to appoint Barbara Albright as the voting delegate for Kansas Association of Counties, Allen seconded and all were in favor. Barbara made a motion to appoint Harold Coleman as the 1st alternate and Rhonda Dunn as a 2nd alternate for Kansas Association of Counties, Allen seconded the motion and all were in favor.

The Commissioners, Terry Sercer, Terri Johnson and Valorie Leblanc worked on 2015 budgets.

Jim Harris presented chemical bids for Escort Xp, they were as follows…

Van Diest = $1,608.32

Red River = $1,603.84

CPS = $1,585.92

Harold made a motion to accept the bid from CPS, and Allen seconded. Allen asked Jim to find out how much brush has been sprayed with this mixture.

Harold told Jim that Joe Savage said the corner of Soldier & 245th needs sprayed.

There was discussion over the low water crossing on 145th Street. Frank Young made several recommendations on the low water crossing. Allen moved to give Jim approval to proceed with the option of tearing out the entire structure and replacing with a low water bridge 80 feet X 20 feet, using the same elevation as the current bridge, installing a 4X4 box the bridge for low flows, raising the road for approximately 400 feet North of the bridge to an elevation of 1.5 feet, with an estimated cost of $80,000. Jim is to check with KDOT to see if the federal funding is there, Barbara seconded.

Jim said this week they are laying asphalt on Yale Road, ditching in the Bronson area, blasting at the Beth Quarry, as well as helping Kendell move election equipment to the polling places.

Terry Graham came to the Commission meeting; he was advised that Hammond road was going to be worked on in September.

The Commissioners discussed the visit they had earlier from Sandy Winters (regarding the site where the Oberst accident took place on 180th). They said they could possibly put up machine crossing warning signs. Barbara asked Bill Martin about posting speed limit signs; Bill said the engineer would have to give the recommendation on speed limit signs. Jim said he would talk to the engineer about this. Sandy Winters later came to the Commission meeting to inquire about the posting of speed limit signs in the area of the accident, Barbara told her they were waiting to hear from the engineer to make a ruling on what a safe speed limit would be for that area.

Bill Martin and Ben Cole talked to the Commissioners; they said they are trying to be proactive vs. reactive to traffic complaints.

Wayne Peck said there is a lot of traffic in the area of the animal shelter, he wondered what could be done about the low area in the road by his residence; Barbara said she would have this looked at.

Jake Gross told the Commissioners that the roads were looking good. Helen Hixon stopped by the Commission meeting to say “thanks” for all the good work they are doing.

Allen made a motion to approve three culverts as requested by the City of Fort Scott for the new ball field, (they will be installed and maintained by the County) Harold seconded the motion. Allen will let Jim Harris and Dave Martin know about this decision.

Terri Johnson came by the Commission meeting to see if there was anything they needed.

Allen said he would not be at the August 29th Commission meeting.

Doug Hurd a resident of 2505 Limestone road, talked to the Commissioners about the plans for Limestone road. Jim Harris previously suggested overlaying this section of Limestone road and Mr. Hurd wanted to know if that was the plan. Allen said that this is a project on the 2015 schedule, but that any 2014 projects that are unfinished will be moved to 2015 projects. Allen said they are running behind schedule on what they want to complete in 2014. A portion of Limestone road has already been milled; the Commissioners said they plan to prep the road with oil and pack the road later, but do not have a timeline for this. Joe Johnson later talked to the Commissioners about Limestone road as well, he said the milling that has been done on Limestone road has made the road rougher and dusty; he said he had ruined a tire on the milled portion of the road.

The Commissioners discussed the brush that needs sprayed on corners around the County.

Rhonda Dunn talked to the Commissioners about an amendment made that took effect July 1, 2014. The 20.00 mill for school districts will now go directly to the State Treasurer and then the State Treasurer will distribute to each of the school districts.

Dwayne Neil met with the Commissioners about the hay at Elm Creek Lake; he bid the hay to be removed by August 1st, and asked for an extension through August 15th. The Commissioners agreed to the extension.

Peggy Kuns a resident of 752 Xavier road told the Commissioners that Xavier has not been maintained and there are rough spots in the road. The Commissioners said they would take care of this.

Barbara said there is a culvert blocked at 1438 215th.

Barbara made a motion to go into a 15 minute executive session to protect their privacy, Harold seconded motion and all approved. The session included the three Commissioners, Kendell and Deb Schoenberger. No action was taken.

Harold made a motion to go into a 5 minute executive session for non-elected personnel to protect their privacy, Barbara seconded and all approved. No action was taken.

The Commissioners worked on the Commission budget for 2015.

The meeting adjourned at 12:16 pm.
